Terms of Use

1. Eligibility and accounts

You must be at least 13 and legally able to enter this agreement. If you are below the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms and supervise your use. CropIntel is not directed to children under 13.

Provide accurate account information, keep it current, protect your sign-in credentials, and tell us if you suspect unauthorized use. Do not share credentials or impersonate another person. Some features require sign-in, email verification, or farm access approved by an owner. You may delete your account through account settings.

2. Permission to use the Service

Subject to these Terms, CropIntel grants you a limited, non-exclusive, non-transferable, revocable right to use the Service for your own purposes, including operating your farm or agricultural business. This does not authorize resale of the Service, unauthorized bulk access, or representing CropIntel output as your own certified advice.

CropIntel and its licensors retain their rights in the Service, software, models, branding, and content. You retain rights in content you submit. Third-party and open-source materials remain governed by their respective licenses; these Terms do not remove rights those licenses or applicable law grant you.

3. Crop screening and professional judgment

Results are informational screening estimates, not a confirmed diagnosis or a substitute for a licensed agronomist, plant pathology laboratory, or local extension service. A confidence score is a model output, not a guarantee of correctness. Image quality, crop selection, region, and conditions outside the training data can change results.

Do not rely on CropIntel alone for pesticide selection, dosage, application timing, legal-use decisions, crop destruction, food or feed safety, insurance, or other high-consequence decisions. Confirm severe loss, uncertain results, and treatment plans with a qualified professional. Follow current product labels and local requirements. No yield, profit, disease-control, or treatment outcome is promised.

4. Your photos, farm records, and reports

Only upload content and enter farm or location information that you own or have permission to use and share. You grant CropIntel a non-exclusive license to host, process, transmit, and display your content only as needed to provide the features you request, operate and protect the Service, and fulfill applicable legal obligations, consistent with the Privacy Policy. This is not a transfer of ownership or a blanket license to train models on your photos.

Farm discovery information and posted crop reports have the visibility described in the Privacy Policy. Shared photos can be accessed through copied download links. Do not post another person's private information or confidential business information without authority. User reports are not verified outbreak findings; acknowledgements do not prove a diagnosis.

Farm owners control membership and access decisions. You must have authority to act for a farm. Deleting an owner account removes owned farms and associated records, including collaborators' diagnoses and reports. Export records you need before deletion and coordinate with collaborators.

You may send voluntary product feedback that we can use to improve the Service without compensation. This does not give us ownership of your photos, farm records, or confidential information. Do not send trade secrets in unsolicited feedback.

5. Acceptable use

Do not use the Service unlawfully; harass or impersonate others; infringe intellectual property or privacy rights; upload malicious files; post knowingly false, abusive, or misleading crop reports; or attempt to access another person's account or records without permission.

Do not bypass authentication, membership checks, upload limits, or rate limits; interfere with the Service; scrape protected records; extract private credentials or model files; or run unauthorized automated or security testing against production. Restrictions on reverse engineering apply only to the extent permitted by law and the applicable software license.

We may investigate misuse, moderate reports, remove unlawful content, and restrict access as reasonably needed to protect users, comply with law, or enforce these Terms. Contact cropintelar@gmail.com to report misuse or request review of an access or content decision.

6. Third parties and charges

Authentication, map, hosting, app-store, and other integrated services have their own terms and privacy practices. We do not control third-party services or guarantee their availability or the accuracy of their data. Your internet or mobile provider may charge for connectivity.

The current app has no in-app checkout or subscription purchase flow. These Terms do not enroll you in a paid plan or recurring charge. Any future paid offering must disclose its price, billing, cancellation, and refund terms before you purchase. A separate signed customer agreement governs its own subject matter if one applies.

7. Changes, suspension, and termination

Features, supported crops, and models may change. Service interruptions and errors can occur. No particular uptime, response time, support level, or uninterrupted storage is promised unless agreed separately in writing. Keep copies of records you need.

You may stop using the Service and delete your account at any time. We may suspend or terminate access for violations, security risks, legal requirements, or discontinuation. We will provide notice where appropriate and required by law. Privacy, content rights needed for retained records, disclaimers, liability limits, and dispute provisions survive as their nature requires.

8. Warranty disclaimer

TO THE EXTENT PERMITTED BY LAW, THE SERVICE AND ITS OUTPUT ARE PROVIDED AS IS AND AS AVAILABLE, WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS ARE COMPLETE, CORRECT, CURRENT, OR SUITABLE FOR A PARTICULAR FARM OR TREATMENT DECISION, OR THAT THE SERVICE IS ERROR-FREE OR UNINTERRUPTED.

Nothing in these Terms excludes warranties, remedies, or mandatory consumer rights that applicable law does not permit us to exclude.

9. Limitations of liability

To the maximum extent permitted by law, CropIntel and its suppliers are not liable for indirect, incidental, consequential, special, exemplary, or punitive losses, or lost profits, crop yield, business opportunity, or data arising from use of or inability to use the Service. To that same extent, our aggregate liability for claims relating to the Service is limited to the greater of USD 50 or the amount you paid CropIntel for the Service in the six months before the event giving rise to the claim.

These limits do not apply where prohibited by law, including to liabilities that cannot lawfully be limited. They do not remove mandatory consumer rights. You remain responsible for obtaining qualified advice and making lawful farm-management decisions.

10. Disputes, changes, and contact

For a concern or dispute, contact cropintelar@gmail.com with a description and the resolution you seek. We encourage informal resolution, but contacting us is not a prerequisite to exercising a legal right. Disputes may be brought before a court with lawful jurisdiction under applicable law. These Terms do not impose mandatory arbitration, waive class actions, or select an exclusive state or county.

We update the effective date when these Terms change and provide notice of material changes by an appropriate method. Changes apply prospectively after their stated effective date and any notice required by law. Continued use after that point signifies acceptance to the extent permitted by law; stop using the Service if you disagree.

These Terms and the policies they incorporate govern ordinary use of the Service, subject to any separate signed agreement. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Failure to enforce a provision is not a waiver. Nothing prevents contacting a regulator, reporting unlawful activity, or exercising non-waivable rights.
